Last June 2019, Directive (EU) 2019/904 was published, relating to the reduction of certain plastic products in the environment, which indicates that Member States must apply Articles 5 and 7 July 3 2021. Due to this Directive has not yet been incorporated into our legal system, the Ministry for the Ecological Transition and the Demographic Challenge has published an informative note so that, as of July 3, 2021, they are applicable to such items.
On the one hand, Article 5 of this Directive prohibits the placing on the market of single-use plastic products listed in part B of its Annex, as well as products made with oxo degradable plastic.
On the other hand, Article 7 of this Directive establishes marking requirements for the objects listed in its Annex D.
So far, the Ministry of Health, competent in the importation of this type of material, has not ruled on the matter, so it is unknown how it will act at the border.
